Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the FalconryLab mobile application (the "Service") operated by FalconryLab ("us", "we", or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.
1. Agreement to Terms
By creating an account and using FalconryLab, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. This agreement constitutes a legally binding contract between you and FalconryLab.
Your use of the Service is also subject to our Privacy Policy, which describes how the app collects, uses, and shares your information. Use of the falconrylab.com website is covered separately by our Website Privacy & Cookie Notice and by section 19 below.
2. Eligibility
You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into this agreement.
If you are under 18, you represent that you have your parent or guardian's permission to use the Service. Your parent or guardian must review and agree to these Terms on your behalf.
We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without verifiable parental consent.
3. Account Registration
To access certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized account use
You may not use another person's account without permission. You may not create an account using false or misleading information.
4. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the Service on your personal mobile device
- Access and use the Service for your personal, non-commercial purposes
This license does not include the right to:
- Modify, copy, or create derivative works of the Service
- Reverse engineer, decompile, or disassemble the Service
- Rent, lease, lend, sell, or sublicense the Service
- Remove any proprietary notices from the Service
5. User Content
The Service may allow you to post, link, store, share, and otherwise make available certain information, text, graphics, photos, or other content ("User Content"). You are responsible for the User Content you post.
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Service.
You represent and warrant that:
- You own or have the necessary rights to post the User Content
- The User Content does not violate any third party's rights
- The User Content complies with these Terms and all applicable laws
We do not claim ownership of your User Content. You retain all rights to your User Content.
6. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Harass, abuse, or harm another person
- Send spam or unsolicited communications
- Impersonate another person or entity
- Post false, misleading, or deceptive content
- Upload malicious code or interfere with the Service
- Collect user information without consent
- Use the Service for any illegal purpose
- Promote violence or discrimination
- Post content that is obscene, threatening, or defamatory
- Attempt to gain unauthorized access to the Service
Falconry-Specific Prohibited Conduct
- Promoting illegal taking or possession of raptors
- Sharing information that violates federal or state falconry regulations
- Encouraging practices harmful to raptor welfare
- Misrepresenting falconry licensing status or experience
- Posting another person's trapping site, home, or any other precise location without that person's permission
- Disclosing the location of an active nest, eyrie, or aerie, or of any raptor sitting a nest
- Republishing coordinates shared with you through the Service anywhere outside the Service
- Using a shared location to bait, chase, harass, or otherwise disturb a raptor or any other wildlife, or to interfere with another falconer's bird
- Using the Falconry Map to plan, arrange, or carry out any take that is not authorized by your license, your permits, and applicable federal, state, and tribal law
- Trapping, or attempting to trap, on land you do not have lawful permission to be on
- Posting a knowingly false sighting, or misstating a species, a location, or the equipment on a bird
- Passing on an apprentice's hunt locations or tracks to anyone outside your apprenticeship, or working a site you learned about that way without your apprentice's permission
Location Sharing and Personal Safety
Every sighting you record is private to your account unless you make it public. Making a sighting public is a separate, deliberate choice you make on that sighting, and you can delete it at any time. You can also make it private again, unless other members have already messaged you about it: a sighting that other members have opened conversations on can be deleted, but not made private, so that their conversations never point at a pin they can no longer see.
A public sighting is shown to other Falconry Map members at the exact coordinates you marked. We do not move, round, or blur the position: the pin other falconers see is the point you chose, and the species, age, equipment, habitat, the date and time of the sighting, your notes and any photo are published exactly as you entered them. A photograph can identify a place on its own. If you do not want the exact spot known, keep the sighting private.
The Falconry Map is part of a FalconryLab Pro subscription. Falconers without a Falconry Map subscription see no sightings at all and cannot post any.
Once a location is public you cannot control what anyone does with it, and it cannot be taken back out of someone else's notebook, so make public only what you are willing to have known. Your own map always shows your sightings where you marked them, and FalconryLab stores that point so you can edit it later.
Coordinates are shared falconer to falconer, and the people you meet through them are strangers. If you arrange to meet another user in the field, tell someone where you are going and when you expect to return, meet in daylight in a place you can leave freely, and do not enter private land without the landowner's permission. FalconryLab does not verify any user's identity, licensing, or permits, and does not vet the accuracy, legality, or safety of any location a user posts. You are responsible for your own safety and for confirming that any site you visit is one you may lawfully be on.
Sharing With Your Sponsor
If you are an apprentice, your sponsor can see the records you keep in FalconryLab. That is the point of an apprenticeship, and most of it is what you would expect: your birds, their weights, your training sessions, your milestones, and the tasks your sponsor sets you.
Your hunt journal is part of that, and your hunt journal carries locations. A logged hunt records where the hunt started, every waypoint you marked, and the GPS track your phone recorded while you walked. Your sponsor can see all of it, drawn on a map, at the precision your phone recorded it. A track shows the field you worked, the road you parked on, and the hours you were out.
A hunt your sponsor sees is not published to the Falconry Map and goes no further than your sponsor; they see where you actually were.
This goes to your sponsor and to no one else. Other falconers do not see your hunts, and nothing in an apprenticeship publishes your hunts to the map. A hunt you never log has no track to share, and a hunt you delete stops being visible to your sponsor.
Either of you can end the apprenticeship at any time, and completing it ends it as well. Once an apprenticeship is completed, cancelled, or withdrawn, your former sponsor's access to your records ends with it, and hunts you record afterwards are not shared with them.
If you are a sponsor, an apprentice's hunt locations are theirs, not yours. Do not pass them on, and do not work a site you learned about that way without your apprentice's permission.
Zero Tolerance for Objectionable Content and Abusive Users
We have zero tolerance for objectionable content or abusive behavior. You can report any sighting, message, profile, or other user content from within the app (••• on a sighting, long-press a message, or the ••• menu on a profile), and you can block any user (blocked users cannot contact you, are hidden from discovery, and their sightings no longer appear on your map; manage blocks in Settings → Blocked Users).
A sighting reported by three separate falconers is hidden automatically while we review it, and sighting notes and messages are screened against a prohibited-terms list when you submit them.
Reports are reviewed by the FalconryLab team within 24 hours. We may remove content and suspend or permanently terminate the accounts of users who violate this policy. To reach us directly, email support@falconrylab.com.
7. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of FalconryLab and its licensors. The Service is protected by copyright, trademark, and other laws.
Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE
We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that defects will be corrected.
9. Veterinary and Health Disclaimer
IMPORTANT: FalconryLab is designed as a tracking and management tool for falconers. The Service does NOT provide veterinary advice, diagnosis, or treatment.
- Weight tracking, feeding calculations, and health information are for record-keeping purposes only
- The Service is not a substitute for professional veterinary care
- Always consult a qualified avian veterinarian for health concerns about your birds
- We are not responsible for any decisions you make based on data in the app
- The Service does not replace proper falconry training and mentorship
If your bird shows signs of illness, injury, or distress, seek immediate veterinary care. Do not rely on app data to diagnose or treat health conditions.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FALCONRYLAB, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- DAMAGES RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE
- DAMAGES RESULTING FROM ANY UNAUTHORIZED ACCESS TO YOUR ACCOUNT
- DAMAGES RESULTING FROM ERRORS OR OMISSIONS IN THE SERVICE
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. Indemnification
You agree to defend, indemnify, and hold harmless FalconryLab and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your User Content
- Your use of the Service
- Your violation of any third party rights
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and User Content
- Provisions that should survive termination will survive
You may terminate your account at any time by deleting your account through the app settings.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Nevada. You consent to the personal jurisdiction of such courts.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion.
If we make material changes, we will provide notice through:
- A prominent notice within the Service
- An email to the address associated with your account
- A notification when you next use the Service
Your continued use of the Service after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically for any changes.

16. Apple-Specific Terms
If you accessed or downloaded the Service from the Apple App Store, you agree to the following:
- This agreement is between you and FalconryLab, not Apple
- Apple has no obligation to provide maintenance or support for the Service
- Apple is not responsible for any product warranties
- Apple is not responsible for addressing any claims related to the Service
- Apple is a third-party beneficiary of these Terms
You represent that:
- You are not located in a country subject to U.S. Government embargo
- You are not listed on any U.S. Government prohibited or restricted party list
17. Miscellaneous
Entire Agreement: These Terms constitute the entire agreement between you and FalconryLab regarding the Service.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
18. Subscriptions and Auto-Renewal
FalconryLab offers optional auto-renewable subscriptions that unlock additional features. The following terms apply to all subscriptions purchased through the Apple App Store:
- Available plans, their features, and current prices are shown in the app before you purchase. Prices are displayed in your local currency and may vary by region.
- Payment will be charged to your Apple Account at confirmation of purchase.
- A subscription automatically renews for the same period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your Apple Account will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage your subscription and turn off auto-renewal in your device Settings → [your name] → Subscriptions at any time after purchase.
- Where a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription to that product.
- Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then. We do not provide prorated refunds for partial periods. Refunds, where applicable, are handled by Apple in accordance with the App Store Terms of Service.
- If you do not purchase or renew a subscription, you may continue to use the free features of the Service subject to any applicable limits described in the app.
This section supplements Apple's standard Licensed Application End User License Agreement. Your purchase is also subject to Apple's Media Services Terms and Conditions.
19. Website Use and Advertising
Sections 1 through 18 above concern the FalconryLab mobile application. This section concerns the falconrylab.com website.
- The website is supported by advertising. We display third-party ads through Google AdSense. We do not select individual advertisements, and their appearance on our pages is not an endorsement of the advertiser, its products, or its claims.
- The FalconryLab mobile application contains no advertising. Nothing in this section applies to the app.
- Third-party destinations. Advertisements, affiliate links, and other outbound links lead to sites we do not operate or control. We are not responsible for their content, products, pricing, availability, or privacy practices, and your dealings with them are solely between you and them.
- Affiliate relationships. Some outbound product links earn us a commission at no additional cost to you, as described in our Affiliate Disclosure.
- Educational content is not professional advice. The guides on this website describe falconry law and practice for general information. Falconry is regulated at both federal and state level and requirements change; always confirm current requirements with your own wildlife agency before acting.
- Ad blocking. You are free to use ad-blocking software. We do not restrict access to our educational content based on whether ads are displayed.
How the website collects and uses information — including advertising cookies and your choices about them — is described in our Website Privacy & Cookie Notice.
By using FalconryLab, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
