1. Acceptance of Terms

Welcome to FalconryLab. By downloading, installing, or using the FalconryLab mobile application and website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and FalconryLab ("we," "us," or "our"). We reserve the right to update these Terms at any time, and your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

2. Eligibility and Account Registration

2.1 Age Requirement

You must be at least 13 years old to use FalconryLab. If you are under 18, you must have parental or guardian consent to use the Service. By using the Service, you represent that you meet these age requirements.

2.2 Account Creation

To access certain features, you must create an account by providing:

• Accurate and complete registration information
• A valid email address
• A secure password

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion.

3. License to Use the Service

3.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the FalconryLab mobile application on devices you own or control, solely for your personal, non-commercial use.

3.2 Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the Service
• Copy, reproduce, or distribute the Service or its content
• Remove or alter any copyright, trademark, or proprietary notices from the Service
• Use the Service for any illegal, unauthorized, or commercial purpose
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems
• Interfere with or disrupt the Service or servers
• Use automated scripts, bots, or crawlers to access the Service

4. Subscriptions and Billing

4.1 Subscription Plans

FalconryLab offers a Free plan with limited features and paid subscription plans (Pro and Team) with additional features. Subscription details, including pricing and features, are available on our Pricing page and may change at any time with notice.

4.2 Payment

Paid subscriptions are billed through the Apple App Store or Google Play Store. By subscribing, you authorize the respective app store to charge your selected payment method on a recurring basis (monthly or annually) until you cancel.

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage or cancel your subscription at any time through your app store account settings.

4.4 Refunds

All subscription fees are non-refundable except as required by law or at our sole discretion. Refund requests must be submitted through the respective app store, as billing is managed by Apple or Google.

4.5 Price Changes

We may change subscription prices at any time with at least 30 days' notice. Price changes will apply to subsequent billing periods after notice is provided.

5. User Responsibilities

5.1 Lawful Use

You agree to use the Service in compliance with all applicable laws, regulations, and falconry licensing requirements in your jurisdiction. You are solely responsible for ensuring your use of the Service complies with local, state, and federal falconry regulations.

5.2 Accurate Information

You are responsible for the accuracy of all information you enter into FalconryLab, including bird data, weight records, and training sessions. We are not responsible for any consequences resulting from inaccurate or incomplete data.

5.3 Data Backup

While we provide cloud sync and backup features, you are responsible for maintaining your own backups of important data. We are not liable for any data loss, though we will make reasonable efforts to prevent it.

6. Prohibited Uses

You may not use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or any malicious code that could harm the Service or users
• Harass, abuse, threaten, or harm other users (if community features are added)
• Impersonate any person or entity or misrepresent your affiliation with anyone
• Collect or harvest personal information from other users without consent
• Use the Service for any commercial purpose without our express written permission
• Share your account credentials with others

7. Intellectual Property Rights

7.1 Our Intellectual Property

The Service, including all software, designs, text, graphics, logos, icons, images, and other content, is owned by FalconryLab and protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by us.

7.2 Trademarks

"FalconryLab" and our logo are trademarks of FalconryLab. You may not use these trademarks without our prior written consent.

7.3 User Content

You retain ownership of all data, photos, notes, and content you create or upload to FalconryLab ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.

You represent and warrant that you have all rights necessary to grant this license and that your User Content does not infringe on the rights of any third party.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. Please review the Privacy Policy to understand our practices.

10. Disclaimers

10.1 "As Is" Basis

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

10.2 No Guarantee of Accuracy

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We make no guarantees about the accuracy, reliability, or completeness of any content, including weather data, location data, or analytics.

10.3 Not Professional Advice

FalconryLab is a tracking and management tool only. The Service does not provide veterinary, medical, or professional falconry advice. Always consult qualified professionals for matters related to your bird's health and training.

10.4 No Guarantee of Regulatory Compliance

While FalconryLab may help you track information required by falconry regulations, we do not guarantee that using the Service will ensure compliance with all applicable laws. You are solely responsible for understanding and complying with falconry regulations in your jurisdiction.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FALCONRYLAB, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the Service
• Any unauthorized access to or use of our servers or any personal information stored therein
• Any interruption or cessation of the Service
• Any bugs, viruses, or other harmful code transmitted through the Service
• Any errors or omissions in any content
• Any loss or damage to birds, property, or person

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO FALCONRYLAB IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless FalconryLab, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content
• Your violation of any applicable laws or regulations

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at support@falconrylab.com or by deleting the app and your account through the app settings.

13.2 Termination by Us

We may suspend or terminate your account and access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in fraudulent or illegal activity.

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days of termination, after which your data may be permanently deleted from our servers. Certain provisions of these Terms (including disclaimers, limitation of liability, and indemnification) will survive termination.

14. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

We may also add or remove features, change subscription plans, or impose limits on certain features at our discretion.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by:

• Posting the updated Terms on this page with a new "Last Updated" date
• Sending an email notification to your registered email address
• Displaying an in-app notification

Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may terminate your account.

16. Governing Law and Dispute Resolution

16.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You may opt out of this class action waiver by contacting us within 30 days of accepting these Terms.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FalconryLab regarding the Service and supersede all prior agreements.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.

17.5 Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or internet service failures.
